1. Acceptance of Terms

By accessing or using EduNotebook ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and EduNotebook.

If you are using the Service on behalf of a school, school district, or educational institution, you represent that you have the authority to bind that organization to these Terms, and "you" refers to that organization.

2. Description of Service

EduNotebook is an AI-powered educational platform designed for K–12 teachers and students. The Service provides:

  • AI-assisted curriculum generation aligned with provincial and state standards
  • Unit plan, lesson plan, and assessment creation tools
  • Presentation generation with AI-created visual slides
  • Research workspace with web search and source management
  • Socratic tutoring system for student learning
  • Document upload and processing (PDF, DOCX, URLs, YouTube)
  • Classroom management tools for organizing classes, subjects, and students

3. Account Registration

Account Information

To use the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

Password Security

You are responsible for safeguarding the password that you use to access the Service. You agree not to share your password with any third party. You must notify us immediately upon becoming aware of any unauthorized use of your account.

Age Requirements

  • Teacher accounts: You must be at least 18 years of age to create a teacher account.
  • Student accounts: Student accounts must be created with school authorization. Students under 13 may only use the Service with verifiable consent from their school, acting under the COPPA school consent exception. See our Privacy Policy for details.

4. Acceptable Use

Permitted Uses

You may use EduNotebook to:

  • Create and manage curriculum-aligned unit plans, lesson plans, and assessments
  • Generate educational presentations and learning materials
  • Conduct research for educational content development
  • Upload and process source materials for curriculum creation
  • Manage classrooms, subjects, and student assignments
  • Use the Socratic tutoring feature for student learning support

Prohibited Uses

You agree NOT to:

  • Access or attempt to access other users' accounts, data, or content without authorization
  • Use automated scripts, bots, or scrapers to extract data from the Service without prior written consent
  • Upload malicious content, malware, or any material designed to disrupt the Service
  • Use the Service to harass, bully, threaten, or harm any individual, including students
  • Resell, sublicense, or commercially redistribute the Service or its output without authorization
  • Attempt to reverse-engineer, decompile, or extract source code from the Service
  • Use the Service to generate content that violates applicable laws or regulations
  • Circumvent or attempt to circumvent content screening, rate limiting, or other security measures
  • Impersonate another user, teacher, school administrator, or any other person

5. AI-Generated Content

No Guarantee of Accuracy

EduNotebook uses artificial intelligence (including Google Gemini and Perplexity AI) to generate educational content. While we strive for high-quality output, AI-generated content may contain errors, inaccuracies, or omissions. We do not guarantee the accuracy, completeness, or suitability of any AI-generated content.

Professional Responsibility

Teachers and educators are solely responsible for reviewing, verifying, and adapting all AI-generated content before using it in educational settings. AI-generated curriculum materials, assessments, rubrics, and lesson plans should be treated as professional drafts that require expert review.

Educational Aid, Not Replacement

The Service is designed as an educational aid and productivity tool. It is not a replacement for professional educational judgment, pedagogical expertise, or teacher-student interaction. AI-generated content should supplement, not replace, professional curriculum development.

Content Screening

All AI interactions are subject to automated content screening. The Service includes role-aware safety filters that may block or modify content deemed inappropriate. Student interactions are subject to stricter content filtering. We reserve the right to refuse generation of any content that violates our content policies.

6. Intellectual Property

Your Content

You retain full ownership of all curriculum materials, documents, and educational content you create or upload to the Service. EduNotebook does not claim ownership of your content.

AI-Generated Output

AI-generated content produced through your use of the Service (unit plans, assessments, lesson plans, presentations, research reports) is owned by you. You may use, modify, and distribute AI-generated output for educational purposes without restriction.

Platform Intellectual Property

EduNotebook retains all intellectual property rights in the Service itself, including but not limited to the platform software, user interface design, AI prompting systems, curriculum alignment algorithms, and all associated documentation and branding. Nothing in these Terms grants you any right to use EduNotebook's trademarks, logos, or brand assets.

No AI Training on Your Content

We do not use your content, uploaded documents, generated artifacts, or interaction data to train, fine-tune, or improve AI models. All AI processing uses pre-trained models accessed via API calls.

Limited License

By uploading content to the Service, you grant EduNotebook a limited, non-exclusive, royalty-free license to host, process, and display your content solely for the purpose of providing the Service to you. This license terminates when you delete your content or account.

7. Student Data

Our handling of student data is governed by our Privacy Policy, which is incorporated into these Terms by reference. Key commitments regarding student data:

  • We do not sell student data to any third party for any purpose
  • We comply with FERPA (Family Educational Rights and Privacy Act) and COPPA (Children's Online Privacy Protection Act)
  • Student data is used solely to provide educational services
  • Student data is never used for advertising, marketing, or AI model training
  • Schools retain full control over student education records and may request deletion at any time

8. Limitation of Liability

Service Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

No Warranty

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or reliability of any AI-generated content. We do not warrant that the Service will meet your specific educational requirements.

Educational Outcomes

EduNotebook is not liable for any educational outcomes, student performance, or curriculum effectiveness resulting from the use of the Service. Teachers and schools are responsible for evaluating the appropriateness and quality of all educational materials used in their classrooms.

Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL EDUNOTEBOOK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY AI-GENERATED CONTENT OBTAINED FROM THE SERVICE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100 USD) OR THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

9. Account Termination

User-Initiated Termination

You may delete your account at any time through the platform settings. Upon deletion, your account data will be permanently removed within 30 days. Educational content you created may be retained in anonymized form for service improvement analytics, unless you request complete data deletion.

EduNotebook-Initiated Termination

We reserve the right to suspend or terminate your account if you violate these Terms, including but not limited to:

  • Repeated violations of the Acceptable Use policy
  • Attempting to circumvent security measures or content screening
  • Using the Service to harm students or other users
  • Fraudulent or illegal activity

We will provide reasonable notice before termination when possible, except in cases where immediate action is necessary to protect users or the Service.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify users through a prominent notice on the platform and update the "Last updated" date at the top of this page. Your continued use of the Service after modifications constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service and delete your account.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of British Columbia, Canada.
